Karnataka government notifies, permits homoeopathy drug licensing under state drugs control department

Karnat government has now notified and permitted that the homoeopathy manufacture and marketing comes under the purview of the Karnataka drugs control department. The move follows after the government made a comparative study of Allopathy and Ayush drug manufacture and marketing licensing among others. Therefore, inspection of homoeopathy is now shifted from the Karnataka directorate of Ayush to State drugs control department.

The state is home to 232 homoeopathy pharmacies across its 30 districts where Bengaluru urban alone has 130 outlets and Belagavi accounts for 34.

While the additional drugs controller of Karnataka is the licensing authority for manufacturing plants, he has delegated power of licensing control to the assistant drugs controller and Circle officers for the sale of drugs.

Right now the State Ayush department ceases to oversee the issues of licensing and manufacture of homoeopathy medicines. It continues with the other systems of medicine like Ayurveda, Siddha and Unani, there will be close monitoring of these segments in the area of production facility compliance and quality drug sales.
With homoeopathy comes under the ambit of the Karnataka Drugs Control, which will strengthen the quality of drugs accessed by the patients, stated a senior official.

Commenting on the move was JSD Pani, president, Karnataka Indian Medicine Manufacturers Association, said the state government has notified on May 28, 2018, the officers in the Drugs Control Department as Drugs Inspectors for Homeopathy Drugs Inspectors under Sec 21(1) of the Drugs and Cosmetics Act 1940 and also Licensing Authority and Controlling Authority as per the provisions of the D&C Act and Rules.

Now this followed after an RTI application in August 2017 revealed a surprising information. An officer having a homoeopathy medicine degree notified under Sec 33G(1) of the Drugs and Cosmetics Act 1940 was working as Homoeopathy Drugs Inspector since July 2015. Notification under Sec 33G(1) refers Drugs Inspectors for Ayurveda, Siddha and Unani Drugs.

Homoeopathy drugs inspector shall be notified under Sec 21(1) of the Drugs and Cosmetics Act 1940 and more so, the said officer was not having qualification prescribed for drug Inspector to be notified under Sec 21(1). A complaint was filed before Director, Ayush Dept, to initiate disciplinary action against all those responsible for issue of such a legally not tenable government notification, he said.

RTI applications revealing lot of skeletons in the cupboard of the office of the Drug Licensing Authority, Ayush Department. Two complaints are before Lokayukta and documents are available for making another 4 to 5 complaints on the administrative corruption in this office, said Pani.

Going by the legal provisions, all the inspections, issue of licenses, renewal of licenses and legal actions initiated if any, by this officer against the homoeopathy drugs manufacturers/sellers are not legally valid. Hence, state government notified that the officers in the Karnataka drugs control department as Drugs Inspectors for Homoeopathy Drugs Inspectors, said Pani.
